1. Agreement to Terms

By accessing or using PEwise ("Service," "Platform," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Account Registration

To access certain features, you must register for an account:

• You must provide accurate, current, and complete information
• You must be at least 18 years old to create an account
• You are responsible for maintaining the security of your account
• You must immediately notify us of any unauthorized access
• One account per person; sharing accounts is prohibited

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Course Access and Enrollment

3.1 Free Trial

The first 2 modules of our PE Geotechnical course are available for free. No credit card required.

3.2 Paid Enrollment

Full course access requires a one-time payment of $90 for 3 months of access. Upon payment:

• You receive immediate access to all course materials
• Access expires 3 months from enrollment date
• You may extend access by contacting support
• Course content may be updated during your access period

3.3 License to Use

Upon enrollment, you receive a limited, non-exclusive, non-transferable, revocable license to access and use the course materials solely for your personal, non-commercial use.

5. Refund Policy

5.1 14-Day Money-Back Guarantee

We offer a 14-day money-back guarantee if:

• Request is made within 14 days of purchase
• You have completed less than 25% of course content
• No evidence of content theft or policy violations

To request a refund, email support@pewise.comwith your order details. Refunds are processed within 5-10 business days.

5.2 Pass Guarantee (Free Retake)

If you complete the course but do not pass the PE Geotechnical exam:

• Contact us with your exam results
• Receive another 3 months of full course access completely free
• This is NOT a refund—we provide extended access instead
• Valid for one retake per customer

5.3 Refund Exclusions

Refunds are NOT available if:

• More than 14 days have passed since purchase
• You have completed 25% or more of the course
• You have already received a refund for this course previously. We allow ONE refund per customer per course. If you repurchase after receiving a refund, that purchase is final and non-refundable.
• You have violated these Terms (especially copyright policies)
• Your account has been suspended or terminated for violations

6. Acceptable Use

You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit viruses, malware, or harmful code
• Attempt to gain unauthorized access to the platform
• Harass, abuse, or harm other users
• Use the Service for commercial purposes without permission
• Create multiple accounts to circumvent restrictions

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEWISE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages exceeding the amount you paid for the Service ($90)

8. Indemnification

You agree to indemnify and hold harmless PEwise from any claims, damages, liabilities, and expenses (including attorney fees) arising from your use of the Service or violation of these Terms.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service constitutes acceptance of the modified Terms.

10. Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Violation of these Terms
• Copyright infringement or content sharing
• Fraudulent activity
• Any reason at our sole discretion

Upon termination, your right to use the Service will immediately cease. Termination for policy violations does not entitle you to a refund.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes shall be resolved in courts located in the jurisdiction where PEwise operates.
